Prop Hire Agreement

1. General Terms

1.1. Hire Agreement

By hiring props from Neon Monster / The Last Survivors (“the Company”), you (“the Hirer”) agree to be bound by these Terms and Conditions. All bookings are subject to availability and confirmation by the Company.

1.2. Use of Props

All items hired are intended for static display only unless otherwise agreed in writing. Any use involving physical interaction, movement, or practical effects must be discussed with and approved by the props team prior to hire. Use beyond agreed static display is at the Hirer’s own risk. Any resulting damage will be fully chargeable.

1.3. Care of Hired Items

Props must be treated with care and respect. No adhesives, paints, or other substances may be applied to props without explicit written permission from the Company.

2. Equipment Responsibility, Insurance, and Sub-Hire

2.1. Hirer’s Responsibility for Equipment

The Company (or its representative/agent) is responsible for the Equipment whilst it is in their possession for the purposes of delivery or collection.
The Hirer shall assume full responsibility for the Equipment from the moment of collection by the Hirer (or upon delivery, once the items are handed over) until its safe return to the Rental Company’s designated premises (or until collected by the Company or its representative). This responsibility includes, but is not limited to, all risks of loss, theft, damage, or destruction of the Equipment, howsoever caused, during the hire period. The Hirer agrees to return the Equipment in the same condition as received (subject to reasonable wear and tear) and shall be liable for the full cost of repair or replacement (at the Rental Company’s discretion) should the Equipment be returned damaged, incomplete, or not returned at all.

2.2. Insurance and Indemnity

The Hirer shall, at their own expense, effect and maintain comprehensive insurance coverage for the Equipment for its full replacement value against all risks, including loss, theft, damage, and third-party liability, for the entire hire period from collection to return. The insurance policy must name the Rental Company as an additional insured party or loss payee, and evidence of such insurance must be provided to the Rental Company upon request prior to collection.
If the Equipment is hired for strictly personal, private, or domestic use (not commercial, public, or business purposes), the Hirer is not required to obtain public liability insurance. However, the Hirer remains personally liable for any loss of, or damage to, the Equipment during the hire period and may be required to cover all associated repair or replacement costs as set out in these terms.
The Hirer agrees to indemnify, defend, and hold harmless the Rental Company, its employees, and agents from and against any claims, losses, damages, costs, or liabilities (including legal fees) arising out of the use, possession, or operation of the Equipment during the hire period.

2.3. Sub-Hire Restrictions

The Hirer shall not sub-hire, lend, or otherwise permit any third party to use the Equipment without the prior express written consent of the Rental Company. Any authorised sub-hire shall only be permitted on terms no less onerous than those set out in this Agreement, and the Hirer shall remain fully liable to the Rental Company for compliance with all obligations herein, including the safe custody, condition, and return of the Equipment. The Hirer shall ensure that any sub-hirer is bound by equivalent insurance and indemnity obligations as stipulated in this Agreement, and the Rental Company reserves the right to withhold consent at its absolute discretion.

3. Charges, Loss, and Damage

The Hirer is responsible for all items from collection/delivery until return (as set out above). Any missing or damaged items will be charged at replacement value or as specified in these terms, on the item page, or detailed in a separate invoice or document. Late returns may incur additional charges at the Company’s discretion.

4. Liability

The Company accepts no liability for injury, loss, or damage arising from the use of hired props, particularly where used outside their intended purpose or without prior written approval.
All items must be used in accordance with their design and any provided safety guidance.

5. Payment

Full payment must be made prior to or upon collection/delivery before the hire period starts (unless otherwise agreed).

6. Cancellations & Refunds

  • Cancellations made within 5 days of the hire period start will incur 10% of the full charge.

  • Cancellations made within 48 hours of the hire period start will incur 50% of the full charge.

  • Cancellations made within 24 hours of the hire period start will incur 100% of the full charge.
